1. Who we are

These Terms govern your use of the smyleAI website, courses, AI agents, community (“The Circle”), and any related services (the “Service”), operated by smyleAI (“we”, “us”, “our”). By using the Service you agree to these Terms.

2. Acceptance

By creating an account, purchasing a course, subscribing to The Circle, or otherwise using the Service, you confirm that you accept these Terms and that you are at least 18 years old (or have authority to bind the organisation you represent).

3. The Service

smyleAI provides AI education (free and paid courses), AI agent build services, and a private community for women founders. Features, content, and pricing may change over time. We do not guarantee uninterrupted or error-free availability.

4. Acceptable use

You must not, and must not permit anyone else to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Send spam, malware, or attempt to probe, scan, or interfere with the Service’s security.
  • Infringe anyone’s intellectual property, privacy, or other rights.
  • Scrape, reverse-engineer, resell, or redistribute the Service or its content.
  • Share account credentials or community access with people who have not paid for it.

5. AI-generated content

Our courses and agents help you use AI tools to produce content. You are responsible for your prompts, the content you submit, the outputs you publish, and for verifying the accuracy of any AI output before relying on it. AI outputs can be wrong, biased, or incomplete and are not a substitute for professional, legal, medical, or financial advice. You must have the rights to any input content you provide and you must not use the Service to generate illegal content, deepfakes, hate speech, malware, or to attempt to jailbreak third-party AI systems. We may remove content, filter outputs, or suspend accounts that breach this section.

6. Intellectual property

We retain all rights in the Service, including course materials, agent templates, documentation, software, branding, and recordings. We grant you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the content you have purchased for your own personal or internal business use only.

7. Payment, billing, refunds and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle’s buyer terms (paddle.com/legal/checkout-buyer-terms) govern payment, billing, taxes, cancellations and refunds. See our Refund Policy for our refund window.

8. Subscriptions

The Circle is a recurring monthly subscription. It renews automatically until cancelled. You may cancel at any time through Paddle (paddle.net) or by contacting us; your access continues until the end of the paid period.

9. Suspension and termination

We may suspend or terminate your access immediately for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Sections that by their nature should survive termination (IP, liability, governing law) will continue to apply.

10. Warranties and liability

To the fullest extent permitted by law, the Service is provided “as is” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability to you is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where that exclusion is prohibited by law.

11. Indemnity

You agree to indemnify us against any third-party claim arising from your content, your use of the Service in breach of these Terms, or your violation of any law.

12. Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
